Partnership Terms of Agreement
(Accepted upon submission of the Partner Registration Form)
By submitting the partnership form for The Enlightened Pilot program, you (“Partner”) acknowledge and agree to the following terms and conditions established by Capt. Jay Williams (“Program Owner”). These terms outline the responsibilities, benefits, and limitations of participation in the partnership program.
1. Partnership Purpose
The purpose of this agreement is to establish a cooperative relationship between the Partner and The Enlightened Pilot for the promotion and delivery of boating education and training programs to customers, clients, or members.
2. No Cost Participation
There is no financial cost or obligation for the Partner to join or maintain participation in the program. The Partner agrees to promote The Enlightened Pilot course in good faith using approved materials provided by the Program Owner.
3. Revenue Sharing
The Partner will receive 25% of the total net revenue from each course enrollment generated directly through its unique registration link or referral code.
Payments will be issued monthly via electronic transfer or check, accompanied by an itemized report of enrollments.
The Partner is responsible for providing accurate payment information and tax identification details as required by law.
4. Use of Brand and Materials
The Partner may use The Enlightened Pilot name, logo, and approved marketing materials only for promoting the program.
Any modification, reproduction, or creation of new materials using The Enlightened Pilot name or content must receive prior written approval.
The Partner may not represent itself as an agent or employee of The Enlightened Pilot.
5. Participant Experience
All instruction, curriculum, and delivery remain under the direction and supervision of Capt. Jay Williams and his approved facilitators.
The Partner agrees not to alter course content, pricing, or delivery methods without written consent.
6. Liability and Risk
The Partner assumes no liability for the operation or performance of The Enlightened Pilot training sessions.
The Program Owner holds full responsibility for instruction. Program Owner does not guarantee participant safety, performance, or adherence to Course materials.
Both parties agree to hold one another harmless from claims, damages, or losses arising from their respective acts or omissions.
7. Confidentiality
All shared client lists, referral codes, or revenue data are confidential and may not be disclosed to third parties without written consent.
8. Term and Termination
This agreement begins upon form submission and acceptance by The Enlightened Pilot.
Either party may terminate the partnership at any time with written notice.
Any outstanding revenue owed to the Partner will be paid within 30 days of termination.
Program Owner may revise terms without notice.
9. Independent Relationship
This agreement does not create an employer–employee, franchise, or legal agency relationship. Each party operates independently.
10. Governing Law
This agreement shall be governed by and construed under the laws of the State of Iowa, United States.
11. Acceptance
By submitting the Partner Registration Form, you affirm that you have read, understood, and agreed to these terms and conditions, and that you are authorized to act on behalf of your organization.
